1. Eligibility and Accounts

You must be legally able to form a binding contract to use the Platform.

You are responsible for account security, all activity under your account, and ensuring your profile details are accurate and current.

We may suspend or terminate accounts that violate these Terms or applicable law.

2. Platform Role

Racecar Now is an independent marketplace that connects teams and drivers. We are not a party to agreements between users unless explicitly stated otherwise.

You acknowledge that race seat arrangements, event participation, safety requirements, and on-track eligibility are your responsibility and the responsibility of the counterparty you choose to work with.

3. Listings, Requests, and Communications

Teams are responsible for listing accuracy, including event details, pricing, deposits, requirements, and what is included.

Drivers are responsible for truthful profile information, including experience, licensing, and credentials.

You agree not to submit false, misleading, defamatory, harassing, or unlawful content. We may remove content or restrict access at our discretion.

4. Payments, Deposits, and Refunds

Unless otherwise stated, payment and deposit terms are set by the listing provider (team) and agreed directly between users.

Refunds, cancellations, chargebacks, and damage/deposit disputes are handled between the parties involved in the arrangement.

5. Assumption of Risk

Motorsport activities are inherently risky. By using the Platform, you acknowledge and accept those risks, including potential property damage, injury, or death.

You are responsible for obtaining and maintaining any required licenses, certifications, insurance, waivers, and safety compliance documentation.

6. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee listing accuracy, user identity, user performance, event acceptance, race results, uptime, or uninterrupted access.

7. Limitation of Liability

To the maximum extent permitted by law, Racecar Now and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, data, or business opportunities.

To the maximum extent permitted by law, our total liability arising out of or related to these Terms or the Platform will not exceed one hundred U.S. dollars (USD $100).

8. Indemnification

You agree to defend, indemnify, and hold harmless Racecar Now and its operators from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these Terms or law.

9. Prohibited Conduct

You may not use the Platform to violate laws, infringe rights, distribute malware, scrape data in unauthorized ways, interfere with operations, or circumvent security and account controls.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland. Any dispute will be resolved in the courts located in Baltimore County MD, and you consent to their jurisdiction and venue.

11. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted. Continued use of the Platform after updates means you accept the revised Terms.
